These Terms of Service (“Terms”) govern your use of the website operated by LocatePro, LLC (“we,” “us,” or “our”) located at www.LocatePro.net.
By using this website or engaging our services, you agree to these Terms.
1. Nature of Services
We provide utility locating and subsurface imaging services, including but not limited to:
Electromagnetic (EM) utility locating
Ground Penetrating Radar (GPR) scanning
Surface marking using paint and/or flags
Delivery of subsurface mapping data, including GPS coordinates and GIS/CAD file formats such as .shp, .dxf, and .kml/.kmz
All services are performed in accordance with applicable industry practices; however, underground conditions are inherently variable and may limit detection accuracy.
2. No Guarantee of Subsurface Completeness
While we use industry-standard equipment and methods, no utility locating method can guarantee detection of all subsurface utilities or anomalies.
Conditions that may affect results include, but are not limited to:
Depth limitations
Size of target
Soil composition and moisture
Non-conductive or non-metallic utilities/facilities/targets
Inaccurate or incomplete utility records
Site accessibility constraints
Client acknowledges that results are interpretive and probabilistic in nature, not absolute.
3. Client Responsibility
The client is responsible for:
Providing accurate site information and access
Confirming and marking known private utilities prior to work
Notifying us of any site hazards or restrictions
Using delivered data appropriately in engineering, construction, or planning decisions
4. Utility Locating Limitations and Excavation Responsibility
Client acknowledges that utility locating and subsurface imaging services are intended to assist in identifying underground utilities and subsurface features but cannot guarantee the detection of all buried facilities or hazards.
Client further acknowledges that excavation decisions, site safety, and compliance with applicable utility notification requirements, including 811 or other state and local notification systems, remain the responsibility of the client, contractor, excavator, or property owner, as applicable.
Utility locating services provided by LocatePro, LLC are not a substitute for legally required utility notification procedures.
5. Deliverables and Data Products
When requested, for a fee we may provide digital deliverables such as:
GPS coordinate sets
GIS shapefiles (.shp)
CAD drawings (.dxf)
Google Earth files (.kml/.kmz)
These files represent interpreted survey data at the time of collection and are not guaranteed to remain accurate if site conditions change.
6. Payment Terms
Payments may be processed through third-party providers such as Stripe.
Payment is due as agreed in project quotes or invoices
We reserve the right to require deposits before work begins
Late or failed payments may result in delayed or withheld deliverables
All payment processing is subject to the terms of the payment provider
7. Limitation of Liability
To the maximum extent permitted by law, LocatePro, LLC shall not be liable for any:
Indirect or consequential damages
Construction delays
Utility strikes or damages occurring after service completion
Reliance on data beyond its intended use
Client assumes responsibility for how provided information is used in planning and execution.
8. Website Use
This website is provided for informational and service-request purposes only. You agree not to misuse the website or attempt to interfere with its operation.
9. Intellectual Property
All website content, including text, graphics, and branding, is owned by LocatePro, LLC unless otherwise stated. Deliverable data provided to clients may be used solely for the intended project scope unless otherwise agreed in writing.
10. External Services
We may use third-party services such as:
Payment processors (e.g., Stripe)
Email services (hosted email)
Analytics tools
We are not responsible for the policies or practices of these providers.
11. Changes to Terms
We may update these Terms at any time. Continued use of the website or services constitutes acceptance of the updated Terms.
